Blue EX Couriers - benefits delivered ::: Terms and Conditions

By tendering materials for shipment to UNS Blue Ex, the shipper agrees to the terms and conditions stated herein and to standard conditions of carriage, which are incorporated into this contract by reference and which are available from on for inspection at any UNS Blue Ex Express outlet. No agent or employee of UNS Blue Ex or the shipper may alter or modify these terms and conditions.

THE CONSIGNMENT NOT
This UNS Blue Ex’s consignment is NON NEGOTIABLE and the shipper acknowledges that it has been prepared by the shipper or by UNS Blue Ex on behalf of the shipper. The shipper warrants that the shipper is the owner of the goods transported hereunder, or it is the authorized agent of the owner of the goods, and that it hereby accepts UNS Blue Ex terms and conditions for itself and agent for and on behalf of any other person having any interest whatsoever in the shipment.
SHIPPER’S OBLIGATIONS AND ACKNOWLEDGEMENTS
1. The shipper warrants that each article in the shipment is properly and accurately described on this consignment note and that the shipment does not include any article which has been described by UNS Blue Ex to be unacceptable for transportation and that the shipment is properly marked, addressed, and packed to ensure safe transportation with ordinary care and handling
2. The shipper hereby acknowledges that UNS Blue Ex may abandon and/or release any item consigned by the shipper to UNS Blue Ex which it has declared to be unacceptable, as provided in section 11 hereof or if found to be misdescribed by the shipper herein, whether intentionally or otherwise, without incurring any liability whatsoever and the shipper will save, defend, indemnify and hold UNS Blue Ex harmless from and against all claims, damages, fines, losses and expenses arising therefrom. The shipper shall be liable for all costs and expenses related to the shipment or for warehousing the shipment pending disposition.
3. The shipper hereby acknowledges and undertakes that the shipper shall pay to UNS Blue Ex Couriers all taxes/levies/Octroi charges which may have been levied on the shipped goods during transportation to the destination. The shipper further undertakes that any costs/expenses incurred by UNS Blue Ex on account of non-payment of these taxes/levies/Octroi charges by the consignee shall be payable to UNS Blue Ex prior to handing over the possession of the shipped goods to the consignee.
4. The shipper hereby confirms that the shipped goods are properly and adequately packed for transportation by air/ road and during the course of transit.
RIGHT OF INSPECTION OF SHIPMENT
UNS Blue Ex has the right, not the obligation, to inspect any shipment, including without limitation opening the shipment. UNS Blue Ex shall be entitled to refuse to transport any shipment which, upon such inspection, is found to be violative of any of these terms and conditions. Upon such refusal, UNS Blue Ex shall notify the shipper or the same who may collect the shipment after payment of storage/warehousing/other charges in respect thereof.

LIEN ON GOODS SHIPPED
UNS Blue Ex shall have a lien on any goods shipped for all freight charges, levies, taxes, Octroi duties, advantages or other charges of any kind arising out of the transportation hereunder and may refuse to surrender possession of the goods until such charges are paid.

LIMITATION OF LIABILITY
1. The shipper hereby agrees that in case of any damage or loss to the shipment or any part thereof, UNS Blue Ex shall be entitled to have the same assessed/ evaluated through independent surveyors who shall prepare a reasonable evaluation of the damages/ loss caused to the shipment, UNS Blue Ex shall thereof be further entitled to pay compensation to the shipper in terms of the said evaluation of the surveyor(s). provided always that the maximum liability of UNS Blue Ex to pay any compensation for damage/loss to the shipment under this clause shall in no case exceed:
  1. Rs. 100 or
  2. The amount of loss or damage to a document or parcel actually sustained or
  3. The actual value of the document or parcel as determined under 6 hereof, without regard to its commercial utility or special value to the shipper
ACTUAL VALUE
1. The Actual Value of a document (which term shall include any item of no commercial value which is transported hereunder) shall be ascertained by reference to its cost of preparation or replacement, reconstruction or reconstitution value at the time and place of shipment whichever is less.
2. The Actual Value of a parcel (which item shall include any item of no commercial value which is transported hereunder) shall be ascertained by reference to its cost of repair or replacement, resale or fair market value at the time and place of shipment, whichever is less. In no event shall such value exceed the original cost of the article actually paid by the shipper plus 10 %.
CONSEQUENTIAL DAMAGES EXCLUDED
UNS Blue Ex shall not be liable, in any event for consequential or special damages or other indirect loss however arising whether or not UNS Blue Ex had knowledge that such damage might be incurred, including but not limited to loss of income, profit, interest, utility or loss of market.
LIABILITIES NOT ASSUMED
The shipper hereby acknowledges that it has been informed by UNS Blue Ex that the shipment shall be transported, be exposed to all risks associated with such mode of transportation. Subject to the aforesaid, UNS Blue Ex will endeavour to exercise its best efforts to provide expeditious delivery of the shipment in accordance with its regular schedule. UNS Blue Ex WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE FOR DELAY IN PICK UP, TRANSPORTATION OR DELIVERY OF ANY SHIPMENT REGARDLESS OF THE CAUSE OF SUCH DELAY.
Further, UNS Blue Ex Couriers shall not be liable for any loss, damages, misdelivery or non-delivery due to
1. Acts of God, force of majeure or any cause beyond the reasonable control of Blue Ex Couriers, or
2. The act, default or omission of the shipper, the consignee or any other party who claims an interest in the shipment (in the shipment (including violations of any term or condition hereof) or of any person other than UNS Blue Ex Couriers or of any Government officials, or of the Postal Services or any other entity or person to whom a shipment is tendered by UNS Blue Ex Couriers for transportation to a location not regularly served by UNS Blue Ex, regardless of whether the shipper had knowledge of such third party delivery arrangements.
3. Any defect, characteristics, or inherent vice in the nature of the shipment, and/or improper insufficient or defective packing of the shipment even if the same was known to UNS Blue Ex when they accepted such shipment; and
4. Electrical or magnetic energy or other such damage to electronic or photographic images or recording in any form.
CLAIMS
1. Any claim must be brought by the shipper and delivered in writing to the nearest office of UNS Blue Ex from where the shipment was accepted with thirty (30) days of such acceptance. No claim shall be entertained by UNS Blue Ex outside of this time limit.
2. No claim for loss or damages will be entertained until all transportation charges have been paid. The amount of any such claim not be deducted from any transportation owed to UNS Blue Ex Couriers. In case of any delay in the payment of an invoice, UNS Blue Ex reserves the right to charge penalty at the rate of 0.1% on the unpaid invoice amount per day.
APPLICABILITY
These terms and conditions shall apply to and insure the benefits of UNS Blue Ex, its assigns, authorized affiliated companies, director, officers and employees.
Receipt by a person or by his agent or representative entitled to delivery of shipment without complaint is prima facie evidence that the same has been delivered in good condition and in accordance with the contract of carriage.
MATERIAL NOT ACCEPTABLE FOR TRANSPORTATION
UNS Blue Ex will not carry currency, plants, negotiable instruments in bearer forms, lewd obscene or pornographic material, jewelry, contraband goods, industrial carbons and diamonds, bullion, works of art, antiques, precious metals and stones, hazardous or combustible materials, liquor, explosives, stamps, animals, perishable items, restricted drugs, narcotics, fire arms, items/articles restricted by IATA (International Air Transport Association) or ICAO (International Civil Aviation Organization) and any items/articles which are prohibited by any law, regulation or statute of any Provincial or Federal Government of Pakistan.
INSURANCE
1. At the request of the shipper and upon payment thereof, UNS Blue Ex will arrange insurance on behalf of the shipper
2. The insurance coverage shall be governed by all the terms and conditions contained in this policy of insurance issued by the insurance company.
3. CONSEQUENTIAL DAMAGES AND LOSS OR DAMAGE RESULTING FROM DELAYS OF TRANSPORTATION ARE NOT COVERED BY ANY SUCH POLICY OF INSURANCE.

IN COMPLIANCE WITH PAKISTAN POST OFFICE ACT OF 1898, UNS BLUE EX WILL NOT ACCEPT LETTERS OR POST CARDS AS THEIR CARRIAGE IS THE EXCLUSIVE PRIVILEGE OF THE FEDERAL GOVERNMENT.

All payments are to be made in the name of Universal Network Systems Pvt. Ltd via demand draft or cross-cheque. Payments are to be made within 7 days of receipt of Invoice. UNS Blue Ex reserves the right to withdraw any service facility in the case of delay of more than 30 days of settlement of account. In case the account is not settled within 30 days of receipt of Invoice. UNS Blue Ex reserves the right to levy financial changes on outstanding invoice amounts at the rate of 0.1% per day till complete clearance of total dues.
